HeyTripper — Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the HeyTripper mobile application (the "App" or "Service"), operated by Yechan Park ("HeyTripper," "we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.

2. Description of the Service

HeyTripper helps you discover travel destinations using AI. You describe what kind of place you're looking for — a mood, a category, or free text — and the App:

  • Turns your input into a search plan using a generative AI model (Google Gemini).
  • Looks up matching real-world places using Google's Places and Geocoding APIs.
  • Shows you the result with a name, description, and photo.
  • Lets you save ("like") places you're interested in to a personal list, organized by country, and view them on a map.

HeyTripper is a discovery and bookmarking tool. It does not book, reserve, or process payments for any third-party venue, and it does not guarantee the accuracy, availability, opening hours, or existence of any place shown in the App (see Section 8).

3. Eligibility

You must be at least 14 years old to use the App. If you are using the App on behalf of a minor, you represent that you are their parent or legal guardian and consent to this on their behalf where required by local law.

4. No Account Required; Local Data

HeyTripper does not require you to create an account, and we do not operate a backend server that stores your personal data. Your saved places, search history counters, and language preference are stored locally on your device only. See our Privacy Policy for details. Because this data lives on your device, uninstalling the App or clearing its storage will permanently delete it — we cannot recover it for you.

5. Free Usage Limits and Search Pass

  • The App currently provides a limited number of free AI-assisted searches per day (displayed in the App; currently 5, resetting at midnight Korea Standard Time). This limit exists because each search consumes paid third-party API calls, and is subject to change without prior notice.
  • HeyTripper may introduce paid tiers (referred to in the App as "Search Pass") that unlock additional searches or features, whether as one-time purchases or subscriptions. If and when such paid tiers become available for purchase, additional payment-specific terms — including pricing, billing cycle, and refund policy — will be presented to you at the time of purchase and are incorporated into these Terms by reference.
  • We may change free usage limits, introduce, modify, or discontinue paid tiers at any time.

6. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable law or regulation.
  • Attempt to circumvent, disable, or manipulate the daily search limit (e.g., by modifying device clocks, automating requests, or reverse engineering the App) to gain unauthorized access to the underlying third-party APIs.
  • Scrape, harvest, or bulk-extract data returned by the App.
  • Reverse engineer, decompile, or disassemble the App except as permitted by applicable law.
  • Use any automated system (bot, scraper, etc.) to access the App.
  • Interfere with or disrupt the integrity or performance of the App or the third-party services it relies on.
  • Misrepresent your identity or impersonate any person or entity.

We reserve the right to suspend or terminate access for any user who violates this section, particularly conduct that risks our standing with Google's API terms of service, since our ability to operate the App depends on continued access to those APIs.

7. User Content

When you save a place, you may attach a short personal memo (either typed by you or an AI-suggested draft you choose to keep). This content stays on your device and is not transmitted to us or shared with other users — the App has no social or sharing features. You are solely responsible for anything you write in your memos.

8. Third-Party Content and Services

The App displays place information (names, locations, photos, and links) sourced from Google's Places API and Google Maps. This content:

  • Is provided by Google and third parties, not created or verified by HeyTripper.
  • May be inaccurate, outdated, or incomplete (e.g., a business may have closed, moved, or changed hours since Google's data was last updated).
  • Remains subject to Google's own terms and attribution requirements; where the App links out to Google Maps, you leave the App and are subject to Google's terms and privacy policy.

You should independently verify any place's details (hours, address, availability) before visiting. HeyTripper is not responsible for any loss, inconvenience, or expense arising from relying on information shown in the App.

The App also uses a generative AI model (Google Gemini) to interpret your search input and draft short descriptions. AI-generated text may be inaccurate or include unexpected content; treat it as a suggestion, not a verified fact.

9. Intellectual Property

The App's design, source code, branding, logo, and original content (excluding third-party data described in Section 8) are owned by Yechan Park or its licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use in accordance with these Terms. All rights not expressly granted are reserved.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT PLACE INFORMATION, AI-GENERATED CONTENT, OR SEARCH RESULTS WILL BE ACCURATE, COMPLETE, OR CURRENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEYTRIPPER AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, TRAVEL EXPENSES, OR OPPORTUNITY, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Yechan Park and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the App.

13. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users, us, or third parties. You may stop using the App at any time by uninstalling it, which also deletes your locally stored data (Section 4).

14. Changes to the Service or These Terms

We may modify, suspend, or discontinue any part of the App at any time. We may also update these Terms from time to time; if we make material changes, we will update the "Last Updated" date above and, where required by law, provide additional notice (e.g., an in-app notice). Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Korea, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Seoul, Republic of Korea, unless mandatory consumer-protection law in your country of residence provides otherwise.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
